Abstract:	國際貿易實務講求效率，若是採取傳統民法保證之方式，勢必在申請人與受益人纏訟時，將擔保銀行捲入冗長之訴訟程序中，正是在這樣的背景下，具有獨立性特質之銀行擔保函證乃應運而生。獨立性原則的目的主要在於使擔保銀行之義務不受其他當事人間之契約關係所影響。在獨立擔保函證中，擔保人承擔著不可撤銷、無條件之付款責任，在受益人遵循獨立擔保函證所規定之條件的前提下而提出給付請求時，擔保人無權以受益人在基礎法律關係中違約，或以基礎法律關係的其他理由作為抗辯，或以申請人破產、拒絕對擔保人補償等為由，而拒絕或拖延對受益人之付款。
